High Court Practice

The High Courts of India play a pivotal role in the country’s judicial system, exercising original, appellate, and writ jurisdiction over a wide range of matters. High Courts serve as guardians of constitutional rights, arbiters of complex disputes, and appellate authorities for decisions from lower courts and tribunals. With their broad jurisdiction, High Courts handle everything from constitutional questions and criminal appeals to commercial disputes and service matters.

We have a strong and diverse High Court practice across multiple jurisdictions, including Delhi, Patna, Ranchi and Kolkata High Courts. Our team provides strategic representation and advisory services in a wide spectrum of matters, such as:

• Writ Petitions – under Articles 226 and 227 of the Constitution, including habeas corpus, mandamus, prohibition, certiorari, and quo warranto.
• Civil & Commercial Litigation – appeals, revisions, injunctions, partition suits, property disputes, contractual claims, and commercial disputes under the Commercial Courts Act.
• Criminal Matters – bail and anticipatory bail applications, quashing of FIRs, criminal revisions, criminal appeals, and challenges to investigation or trial processes.
• Service & Employment Law – recruitment disputes, wrongful termination, promotions, disciplinary actions, and service-related writs against government and public authorities.
• Company & Corporate Law – matters relating to Companies Act, oppression & mismanagement, shareholder disputes, and appeals from NCLT/NCLAT orders.
• Insolvency & Bankruptcy (IBC) Appeals* – challenges to NCLT and DRT decisions, creditor and debtor representation. [* In both NCLT and DRT matters, the established legal principle is that High Courts are not a substitute for the specialized appellate tribunals (NCLAT and DRAT). While High Courts retain constitutional writ jurisdiction, they will only use it in rare and exceptional cases involving jurisdictional errors or grave procedural irregularities, not to re-evaluate the merits of a case. Parties must first exhaust their statutory appellate remedies before approaching the High Court. ] 
• Taxation & Revenue Laws – income tax, GST, excise, customs, and other fiscal matters.
• Constitutional Law Issues – challenges to statutes, rules, and administrative actions violating fundamental or legal rights.
• Arbitration-Related Petitions – enforcement, setting aside, and appeals against arbitral awards under the Arbitration and Conciliation Act.
• Land & Property Matters – land acquisition, tenancy disputes, real estate conflicts, and succession issues.
• Education, Election & Administrative Law – disputes relating to elections, education boards, universities, government tenders, and administrative actions.
• Consumer & Regulatory Appeals – against orders of consumer commissions, SEBI, TRAI, RBI, and other statutory bodies.
